PRIVACY POLICY OF THE ONLINE STORE

§ 1
GENERAL PROVISIONS

  1. The administrator of personal data collected through the online store www.bikestacja.pl is Łukasz Ryż, conducting business under the name RYŻ ŁUKASZ "BIKESTACJA" CIVIL PARTNERSHIP, registered in the Central Register and Information on Economic Activity of the Republic of Poland maintained by the Minister competent for economic affairs, place of business and address for correspondence: ul. Garncarska 8, 59-700 Bolesławiec, NIP: 6121643148, REGON: 020037737, and Rafał Iwan, conducting business under the name IWAN RAFAŁ "BIKESTACJA" CIVIL PARTNERSHIP, registered in the Central Register and Information on Economic Activity of the Republic of Poland maintained by the Minister competent for economic affairs, place of business and address for correspondence: ul. Garncarska 8, 59-700 Bolesławiec, NIP: 6121643763, REGON: 020174606, conducting business in the form of a civil partnership "BIKESTACJA" CIVIL PARTNERSHIP ŁUKASZ RYŻ, RAFAŁ IWAN, NIP: 6121808201, REGON: 020728170, address for correspondence: ul. Garncarska 8, 59-700 Bolesławiec, email address: sklep@bikestacja.pl, phone number: +48 757 322 093, hereinafter referred to as the "Administrator," also serving as the "Service Provider."
  2. The personal data collected by the Administrator through the website are processed in accordance with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons concerning the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter referred to as GDPR.
  3. All words or expressions written in uppercase letters in the content of this Privacy Policy shall be understood in accordance with their definition included in the Regulations of the online store www.bikestacja.pl

 

§ 2
TYPE OF PROCESSED PERSONAL DATA, PURPOSE, AND SCOPE OF DATA COLLECTION


1. PURPOSE OF PROCESSING AND LEGAL BASIS. The Administrator processes the personal data of Service Recipients of the Store www.bikestacja.pl in the following cases:

  • registration of an Account in the Store for the purpose of creating an individual account and managing this Account based on Article 6(1)(b) of the GDPR (performance of a contract for the provision of electronic services in accordance with the Store's Regulations),
  • placing an Order in the Store to execute a Sales Agreement based on Article 6(1)(b) of the GDPR (performance of a sales agreement),
  • subscribing to the Newsletter for the purpose of receiving commercial information electronically. Personal data is processed upon separate consent, based on Article 6(1)(a) of the GDPR,
  • using the Opinion System to allow the Customer to express their opinion on the Product purchased in the Store and the Sales Agreement with the Seller, based on Article 6(1)(f) of the GDPR (legitimate interests of the entrepreneur),
  • using the Contact Form to send a message to the Administrator based on Article 6(1)(f) of the GDPR (legitimate interests of the entrepreneur).

2. TYPE OF PERSONAL DATA PROCESSED. The Service Recipient provides, in the case of:

  • Account: email address,
  • Orders: first name and last name, address, tax identification number, email address, phone number,
  • Newsletter: first name and last name, email address,
  • Opinion System: first name and last name, email address,
  • Contact Form: first name and last name, email address, phone number.

3. PERIOD OF ARCHIVING PERSONAL DATA. The personal data of Service Recipients is stored by the Administrator:

  • in cases where the basis for data processing is the performance of a contract, for as long as it is necessary to fulfill the contract, and thereafter for a period corresponding to the statute of limitations. If a specific provision does not state otherwise, the limitation period is six years, and for claims related to periodic performance and business activities - three years.
  • in cases where the basis for data processing is consent, for as long as the consent is not withdrawn, and after the withdrawal of consent, for a period corresponding to the statute of limitations for claims that the Administrator may raise and that may be raised against the Administrator. If a specific provision does not state otherwise, the limitation period is six years, and for claims related to periodic performance and business activities - three years.

4. When using the Store, additional information may be collected, including: the IP address assigned to the Service Recipient's computer or the external IP address of the Internet provider, domain name, browser type, access time, operating system type.
5. After obtaining separate consent based on Article 6(1)(a) of the GDPR, data may also be processed for the purpose of sending commercial information electronically or making telephone calls for direct marketing - in accordance with Article 10(2) of the Act of 18 July 2002 on the provision of electronic services or Article 172(1) of the Act of 16 July 2004 - Telecommunications Law, including those sent as a result of profiling, if the Service Recipient has given the relevant consent.
6. Navigation data, including information about the links and references to which they choose to click or other actions taken in the Store, may also be collected from Service Recipients. The legal basis for such actions is the legitimate interest of the Administrator (Article 6(1)(f) of the GDPR) consisting in facilitating the use of electronically provided services and improving the functionality of these services.
7. Providing personal data by the Service Recipient is voluntary.
8. The Administrator takes special care to protect the interests of individuals whose data is processed, and in particular ensures that the data collected by him is:

  • processed in accordance with the law,
  • collected for specified, lawful purposes and not subjected to further processing inconsistent with those purposes,
  • factually correct and adequate in relation to the purposes for which they are processed and stored in a form that allows the identification of the persons to whom they relate, for no longer than is necessary to achieve the purpose of processing.

 

§ 3
SHARING OF PERSONAL DATA


1. Personal data of Service Recipients are transferred to service providers used by the Administrator in running the Store, in particular to:

  • entities delivering Products,
  • payment system providers,
  • survey and opinion system providers,
  • accounting office,
  • hosting provider,
  • software providers enabling business operations,
  • entities providing mailing systems,
  • software providers necessary for running an online store.

2. Service providers (referred to in paragraph 1 of this section) to whom personal data are transferred either follow the Administrator's instructions regarding the purposes and methods of processing such data (data processors), or they independently determine the purposes and methods of their processing (data controllers).
3. Personal data of Service Recipients are stored exclusively within the European Economic Area (EEA), subject to § 5 point 5 and § 6 of the Privacy Policy.

§ 4
RIGHT TO CONTROL, ACCESS TO OWN DATA CONTENT, AND THEIR CORRECTION

1. The person whose data are concerned has the right to access the content of their personal data and the right to correct, delete, restrict processing, the right to data portability, the right to object, the right to withdraw consent at any time without affecting the lawfulness of processing based on consent before its withdrawal.
2. Legal bases of the Service Recipient's requests:

  • access to data - Article 15 of the GDPR,
  • rectification of data - Article 16 of the GDPR,
  • erasure of data (the right to be forgotten) - Article 17 of the GDPR,
  • restriction of processing - Article 18 of the GDPR,
  • data portability - Article 20 of the GDPR,
  • objection - Article 21 of the GDPR,
  • withdrawal of consent - Article 7(3) of the GDPR.

4. In the event of a Service Recipient exercising a right arising from the above rights, the Administrator shall fulfill the request or refuse to fulfill it promptly, but no later than one month after receiving it. However, due to the complex nature of the request or the number of requests, the Administrator may not be able to fulfill the request within one month. In such cases, the Administrator shall fulfill the request within the next two months, informing the Service Recipient in advance within one month of receiving the request about the intended extension of the deadline and the reasons for it.
5. If it is determined that the processing of personal data violates the provisions of the GDPR, the person whose data are concerned has the right to lodge a complaint with the President of the Personal Data Protection Office.

§ 5
"COOKIES" FILES

 

  1. The Administrator's website uses "cookies".
  2. Installing "cookies" is necessary for the proper provision of services on the Store's website. "Cookies" contain information necessary for the proper functioning of the site and also provide the possibility to generate general statistics of website visits.
  3. Two types of "cookies" are used on the website: "session" and "persistent" "cookies".
  • "Session" "cookies" are temporary files that are stored on the Service Recipient's end device until logging out (leaving the site),
  • "Persistent" "cookies" are stored on the Service Recipient's end device for the time specified in the "cookies" parameters or until they are deleted by the Service Recipient.

4. The Administrator uses their own cookies to better understand how Service Recipients interact with the content of the site. The files collect information about the Service Recipient's use of the website, the type of page from which the Service Recipient was redirected, and the number of visits and the time of the Service Recipient's visit to the website. This information does not record specific personal data of the Service Recipient but is used to compile usage statistics of the site.
5. The Administrator also uses external cookies to collect general and anonymous statistical data through Google Analytics analytical tools (external cookies administrator: Google LLC, based in the USA).
6. Cookies may also be used by advertising networks (in particular, the Google network) to display ads tailored to the way the Service Recipient uses the Store. For this purpose, they may store information about the Service Recipient's navigation path or the time spent on a particular page.
7. The Service Recipient has the right to decide on the extent of access to "cookies" on their computer through:

  • choosing the types of cookies to be collected, to which consent is given immediately after entering the Store's website and seeing the cookie-related message,
  • changing settings in your browser window. Detailed information about the possibilities and methods of handling "cookies" is also available in the settings of the software (web browser).

 

§ 6
ADDITIONAL SERVICES RELATED TO USER ACTIVITY IN THE STORE

 

  1. The Store uses so-called social media plugins ("plugins") from social media services. By displaying the website www.bikestacja.pl, containing such a plugin, the Service Recipient's browser will establish a direct connection to the servers of Facebook and Instagram.
  2. The content of the plugin is transmitted directly to the Service Recipient's browser by the respective service provider and integrated with the site. Thanks to this integration, service providers receive information that the Service Recipient's browser has displayed the page www.bikestacja.pl, even if the Service Recipient does not have a profile with the respective service provider or is not currently logged in. This information (along with the Service Recipient's IP address) is transmitted directly to the server of the respective service provider (some servers are located in the USA) and stored there.
  3. If the Service Recipient logs into one of the above social media services, that service provider will be able to directly associate the visit to the page www.bikestacja.pl with the Service Recipient's profile on the respective social media service.
  4. If the Service Recipient uses a specific plugin, for example, by clicking the "Like" button or the "Share" button, the relevant information will also be transmitted directly to the server of the respective service provider and stored there.
  5. The purpose and scope of data collection, as well as their further processing and use by service providers, as well as the possibility of contact and the rights of the Service Recipient in this regard and the possibility of making settings to ensure the protection of the Service Recipient's privacy, are described in the privacy policy of the service providers:

If the Service Recipient does not want social media services to associate the data collected during visits to the www.bikestacja.pl page directly with their profile in a specific service, they must log out from that service before visiting the www.bikestacja.pl page. The Service Recipient can also completely prevent the loading of plugins on the page by using appropriate browser extensions, such as blocking scripts using "NoScript."
7. The Administrator uses remarketing tools on their website, such as Google Ads. Using these tools involves the use of cookies from Google LLC. related to the Google Ads service. Within the mechanism for managing cookie settings, the Service Recipient has the option to decide whether the Service Provider can use Google Ads (external cookies administrator: Google LLC, based in the USA) in relation to them.

§ 7
FINAL PROVISIONS

 

  1. The Administrator employs technical and organizational measures to ensure the protection of processed personal data appropriate to the risks and categories of data covered by protection, especially securing data against disclosure to unauthorized persons, taking over by unauthorized persons, processing in violation of applicable regulations, as well as alteration, loss, damage, or destruction.
  2. The Administrator provides appropriate technical measures to prevent unauthorized acquisition and modification of personal data transmitted electronically.
  3. In matters not regulated by this Privacy Policy, the provisions of the GDPR and other applicable Polish laws shall apply accordingly.
